Reading your employment contract

Ten points to check before you sign. Not legal advice, but experience from many contracts.

  1. Probation period — max. 6 months, notice period during probation usually 2 weeks. Common for physicians in specialist training.
  2. Fixed term — with an objective reason (training, cover) or without (max. 2 years). Ask in writing about the prospects afterwards.
  3. Working time and overtime — "covered by the salary" is only effective within limits. For physicians: are on-call duty (Bereitschaftsdienst) and standby (Rufbereitschaft) regulated separately?
  4. Remuneration — base salary, variable components, target agreement, payment date. For dentists: from what threshold does the revenue share apply, and what is the calculation basis?
  5. Holiday — statutory minimum 20 days (5-day week), 28 to 30 is common.
  6. Side activities — a duty to notify is normal, a ban only with good reason. Important for teaching, expert opinions, consulting.
  7. Post-contractual non-compete — only effective with compensation (at least 50 % of the last salary). Without compensation: void.
  8. Training cost repayment — permissible, but staggered and with limits; usually not if the employer terminates.
  9. Inventions and publications — central for researchers: Employee Inventions Act (Arbeitnehmererfindungsgesetz), publication approval, data rights.
  10. Notice periods — statutory 4 weeks to the 15th or the end of the month, often extended; the same length for both sides?

As of October 2026, general guidance, not legal advice. If in doubt: an employment law specialist (Fachanwalt für Arbeitsrecht), often available for an initial consultation at low cost.
